Waiver, Release Of Liability, And Assumption Of The Risk Relating To Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Keeping it Personal, LLC (the company who holds REFINE Community Gatherings hereinafter collectively referred to as “KIP”) cannot guarantee that you will not become infected with COVID-19 by attending a KIP event, meeting, gathering, or program. Further, attending a KIP event, meeting, gathering, or program could increase your risk of contracting COVID-19.

I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending a KIP event, meeting, gathering, or program, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 at a KIP event, meeting, gathering, or program may result from the actions, omissions, or negligence of myself or others, including, but not limited to, other attendees and KIP employees, leaders, volunteers, vendors, clients, and independent contractors.

I voluntarily agree to assume all of the risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my KIP event, meeting, gathering, or program (“Claims”). On my behalf, and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, I hereby release, covenant not to sue, discharge, and hold harmless KIP, its leaders, employees, agents, volunteers, directors, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto.

I UNDERSTAND AND AGREE THAT THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF THE RISK INCLUDES ANY CLAIMS BASED ON THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF KIP, ITS LEADERS, EMPLOYEES, AGENTS, VOLUNTEERS, DIRECTORS, AND REPRESENTATIVES, WHETHER A COVID-19 INFECTION OCCURS BEFORE, DURING, OR AFTER ATTENDING ANY KIP EVENT, MEETING, GATHERING, OR PROGRAM.

I HAVE CAREFULLY READ THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF THE RISK AGREEMENT IN ITS ENTIRETY AND FULLY UNDERSTAND ITS CONTENTS. I UNDERSTAND THAT IF ANY PORTION OF THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF THE RISK AGREEMENT IS HELD INVALID, THE BALANCE WILL, NOTWITHSTANDING, CONTINUE IN FULL LEGAL FORCE AND EFFECT. I AGREE THAT ANY CLAIM OR DISPUTE ARISING FROM THIS AGREEMENT SHALL BE GOVERNED BY FLORIDA LAW AND APPLICABLE LAWS OF THE UNITED STATES. THE VENUE FOR RESOLVING SUCH DISPUTES SHALL BE COLLIER COUNTY, FLORIDA. I AM AWARE THAT THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF THE RISK AGREEMENT IS LEGALLY BINDING. BY REGISTERING FOR THE KIP EVENT, MEETING, GATHERING, OR PROGRAM I HAVE EXPRESSLY AGREED TO THIS WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF THE RISK.
